Challenge a CMS decision

CMS mandatory reconsideration: how to challenge a decision

Mandatory reconsideration is the usual first formal step when you disagree with a Child Maintenance Service decision. The key is to challenge the exact decision, explain why it is wrong and support your position with relevant evidence.

Build a mandatory reconsideration request

What is mandatory reconsideration?

It is a request for CMS to look again at a decision. This can be relevant where you think CMS has made an error, missed important evidence or applied the rules incorrectly.

GOV.UK says you normally need to ask within 30 days of the date on a CMS decision letter. If you are late, check the decision letter and official guidance because late requests can involve additional requirements.

What should your request include?

Identify the decision

State the date of the decision and the issue you are challenging.

Explain what is wrong

Set out the factual or legal point clearly. Avoid turning the request into a general complaint about CMS service if the issue is the correctness of a decision.

Say what should change

Explain the outcome you say CMS should reach.

Attach relevant evidence

Use documents that directly support the disputed point, such as care records, income evidence, previous CMS decisions or other relevant correspondence.

What happens after mandatory reconsideration?

CMS issues a mandatory reconsideration notice. If you still disagree, you may be able to appeal to the independent Social Security and Child Support Tribunal. GOV.UK currently says an appeal is normally made within one month of receiving the mandatory reconsideration decision.
